These Terms of Service (“Terms”) are an agreement between you and PrintYourVinyl, LLC, a Georgia limited liability company, 1395 E Cobb Dr, Marietta, GA 30068 (“PrintYourVinyl,” “we,” “us”). They govern your use of printyourvinyl.com (the “Site”) and your purchase of our products. By placing an order, creating an account, or otherwise using the Site, you agree to these Terms, our Privacy Policy, and our Returns, Refunds & 100% Satisfaction Guarantee, each of which is incorporated into these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

2. Custom products; how orders work

Our records are personalized goods, made to order from content you supply. Your order is an offer to purchase; we accept it when production begins. We may decline or cancel any order before production for any lawful reason — including orders we believe may infringe the rights of others under Section 5 — and if we do, we will refund you in full. Because each record is unique to you, you may cancel or change an order only within 12 hours of purchase and only if production has not begun; after that, orders are final except as provided in the Returns, Refunds & 100% Satisfaction Guarantee.

3. Your content

You keep ownership of the photos, artwork, and audio you submit for your order (“Your Content”). You grant PrintYourVinyl and the production and fulfillment partners acting on our behalf a limited, non-exclusive, royalty-free license to store, reproduce, format, and print Your Content solely to produce, quality-check, remake, ship, and support your order. We will not use Your Content for marketing without your separate permission. We may retain Your Content for a limited period after delivery (see our Privacy Policy) to honor remakes, guarantee claims, and reorders.

4. Your content warranties; indemnity

You represent and warrant that: (a) you own Your Content or hold all rights, licenses, and permissions needed for us to reproduce it on a physical record and its packaging; (b) Your Content does not infringe any copyright, trademark, right of publicity, privacy right, or other right of any person; (c) Your Content is not unlawful; and (d) any person identifiable in Your Content has consented to its use. We rely on these warranties to make your product. You agree to indemnify, defend, and hold harmless PrintYourVinyl and its officers, employees, agents, partners, and suppliers from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from Your Content or your breach of these Terms.

5. Copyright and anti-piracy

We respect the rights of artists, songwriters, labels, and photographers, and we expect our customers to do the same. We only produce audio and artwork that customers are authorized to reproduce. We may screen submitted content, require reasonable proof of rights, and refuse or cancel any order we believe may infringe the rights of others (with a full refund if production has not begun). We decline future orders from customers who repeatedly submit infringing content.

If you believe content on our Site or in a product we produced infringes your copyright, send a notice containing the elements required by 17 U.S.C. § 512(c)(3) — identification of the work, the allegedly infringing material, your contact information, good-faith and accuracy statements, and your physical or electronic signature — to: PrintYourVinyl, LLC, Attn: Copyright Agent, 1395 E Cobb Dr, Marietta, GA 30068, or support@printyourvinyl.com. We respond promptly, including removing material and canceling orders where appropriate.

6. Nature of lathe-cut records

Lathe-cut records are individually cut, not mass-pressed, and have characteristic qualities you accept when ordering: light surface noise, occasional pops, and sensitivity to playback equipment. They play best on turntables with a properly weighted tonearm and neutral anti-skate, and may perform poorly on entry-level turntables without tonearm weighting. These characteristics are normal for the medium and are not defects. Genuine defects — and any other dissatisfaction — are covered by our Returns, Refunds & 100% Satisfaction Guarantee.

7. Production and delivery estimates

Production and shipping times shown on the Site are our current good-faith estimates and vary with seasonal volume. If we cannot meet a stated timeframe, we will notify you with a revised date and you may cancel for a full refund. Risk of loss passes to you on delivery; lost or damaged shipments are handled under the Returns, Refunds & 100% Satisfaction Guarantee and, if purchased, shipping protection. International recipients are responsible for import duties and taxes.

8. Pricing and payment

Prices are in U.S. dollars and may change without notice (changes never affect orders already placed). You authorize us and our payment processors to charge your payment method for your order total, including shipping, taxes, and selected add-ons. We may correct pricing or listing errors and cancel affected orders with a full refund.

9. Gift cards

PrintYourVinyl gift cards never expire and carry no fees. They are redeemable store-wide, are not redeemable for cash except where required by law, and cannot be replaced if the code is shared with others.

10. Site use

You may not use the Site for any unlawful purpose, interfere with its operation, scrape it, or upload malicious code. Site content (other than Your Content) belongs to PrintYourVinyl or its licensors and may not be reproduced without our permission. We may refuse service, terminate accounts, or cancel orders for violations of these Terms.

11. Text messages

If you opt in to receive marketing text messages, you agree to receive recurring automated messages (such as offers and cart reminders) at the number you provide. Consent is not a condition of any purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. Your information is handled as described in our Privacy Policy.

12. Disclaimers

Except as expressly stated in these Terms and the Returns, Refunds & 100% Satisfaction Guarantee, the Site and our products are provided “as is,” and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

13. Limitation of liability

To the maximum extent permitted by law, PrintYourVinyl’s total liability for any claim arising out of or relating to an order or these Terms is limited to the amount you paid for the order giving rise to the claim, and neither party is liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, willful misconduct, or gross negligence.

14. Consumer rights

If you are a consumer in a jurisdiction (including the EU, UK, or Australia) whose laws give you rights that cannot be excluded by contract — such as remedies for products that are faulty or not as described — nothing in these Terms limits those rights. Because our products are personalized, statutory “cooling-off” withdrawal rights for distance sales do not apply to them where the law so provides (for example, Article 16(c) of the EU Consumer Rights Directive); your rights for defective goods are unaffected, and our 100% Satisfaction Guarantee applies in addition to, not instead of, your statutory rights.

15. Governing law; disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Subject to mandatory consumer-protection venue rules in your place of residence, the state and federal courts located in Cobb County, Georgia have exclusive jurisdiction over disputes arising out of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version, and material changes will be posted on the Site. Changes apply to orders placed after they take effect.

17. General

These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Site and your orders. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale.
